Driving under the influence of alcohol or drugs or while intoxicated (DUI or DWI) is a serious offense. Not only can it result in a permanent criminal conviction, but it can also result in the suspension of your privilege to drive, the imposition of significant fines, the possibility of jail time, and significant hikes in your insurance premiums.

Virginia law also punishes a variety of other traffic violations as misdemeanors, including reckless driving, aggressive driving, and racing. Even less serious traffic infractions that are not misdemeanors, such as speeding, improper driving, or failure to obey a highway sign or a traffic signal, can result in demerit points on your DMV record, higher insurance premiums, and the possible loss of a Commercial Driver's License (CDL) or the ability to earn a living as a cab driver or in the ride-sharing gig economy.

Types of Traffic Cases We Handle.

We handle all types of traffic and DUI/DWI cases in Northern Virginia in both state and federal courts, including:

  • DUI/DWI and Refusal.  It is unlawful to drive in Virginia while intoxicated or under the influence of alcohol or drugs.  It is also unlawful to unreasonably refuse to provide a breath or blood sample following a proper DUI/DWI arrest.  Virginia is one of the harshest states on DUI offenders. Between the loss of license, possible jail time, significant fines, and the costs of an ignition interlock device and the Virginia Alcohol Safety Action Program (ASAP), a DUI can get very expensive very fast. In addition, a third or subsequent DUI conviction is a felony with far more serious consequences. That's why it is critically important to have an experienced Virginia DUI lawyer to guide you through the process, evaluate the evidence against you, understand your side of the case, and prepare to defend you in court.
 
  • Reckless Driving.​  What is often treated as a simple traffic infraction in other states is frequently charged as a misdemeanor reckless driving offense in Virginia. This includes driving 20 miles per hour or more above the speed limit, or more than 85 miles per hour regardless of the speed limit, failing to maintain control of a car or driving with improperly adjusted brakes, or failing to stop for a stopped school bus loading or unloading passengers. But with proper representation, these charges are often reduced to simple traffic infractions that do not result in a criminal conviction or a significant hike in insurance premiums.
 
  • Hit and Run.  Hit and run is a serious offense in Virginia. Depending on whether a personal injury resulted or the extent of any property damage, this offense can be charged as either a misdemeanor or a felony. Virginia law requires drivers involved in an accident to remain on the scene and exchange information. Failure to do so can result in a permanent criminal conviction, and if personal injury results from the accident, Virginia law imposes a mandatory license revocation for a period of one year.
 
  • Speeding and Other Infractions.  While speeding tickets and other traffic infractions, such as improper driving, failure to obey a highway sign, or failure to maintain lane control, do not result in criminal convictions and can be prepaid before court, depending on your circumstances, these charges may result in serious repercussions. For individuals whose livelihood depends on driving, including CDL drivers, taxi drivers, and Uber or Lyft drivers, even simple speeding tickets or other infractions can result in loss of employment.   • Petition for Restoration of Driver's License.  A variety of offenses can result in the suspension or revocation of the right to drive in Virginia, including vehicular manslaughter, hit and run, and felony DUI. But Virginia law provides a process for petitioning for the restoration of the right to drive after its revocation. We guide clients through that process and help them get back on the road legally.
